This Commercial License Agreement governs commercial use of artwork generated through Fable by Surrealium.
1. LICENSE OVERVIEW
1.1 Standard Personal Use License (Included with All Plans)
All paid plans include a Personal Use License allowing:
Private display in home or personal spaces
Personal social media sharing (non-commercial)
Gifts to friends and family
Personal portfolio use (non-commercial)
Personal Use does NOT allow:
Commercial sale or distribution
Marketing materials for businesses
Product packaging or merchandise
Commercial print-on-demand
Client work or commissioned projects
1.2 Commercial License (Requires Purchase)
A Commercial License grants expanded rights for business and commercial use.
2. COMMERCIAL LICENSE TYPES
2.1 Standard Commercial License - $49 per artwork
Grants rights to:
Use in marketing materials (print & digital)
Social media for business accounts
Business website and blog content
Presentations and proposals
Physical displays in commercial spaces
Up to 1,000 reproductions
Restrictions:
Cannot resell as standalone artwork
Cannot use in templates for resale
Cannot sublicense to others
Must credit Fable in prominent uses (optional but appreciated)
Maximum Value: Up to $10,000 in commercial projects
2.2 Extended Commercial License - $199 per artwork
Includes everything in Standard License, plus:
Merchandise for resale (t-shirts, prints, mugs, etc.)
Product packaging and labels
Print-on-demand products
High-volume reproductions
Book covers and editorial use
App and software interface design
No attribution required
Maximum Value: Large-scale commercial projects
2.3 Enterprise License - Custom Pricing
For large organizations and high-volume needs:
Multiple artworks covered
Company-wide usage rights
White-label rights (case-by-case)
Exclusive usage options
Custom terms available

3. WHAT'S INCLUDED
3.1 License Grant
Upon purchase of a Commercial License, you receive:
Non-exclusive, worldwide rights
Perpetual license (no expiration)
Rights to derivative works based on the artwork
Right to modify for commercial purposes
High-resolution file access
3.2 Artwork Ownership
You own the specific artwork generated, but:
Fable retains IP rights to AI models and generation process
Similar artworks may be generated for other users
License is non-exclusive (others may generate similar art)
4. PERMITTED COMMERCIAL USES
With Standard or Extended Commercial License:
Marketing & Advertising:
Print ads, digital ads, billboards
Brochures, flyers, business cards
Email marketing campaigns
Social media advertisements
Website hero images and graphics
Products & Merchandise:
(Extended License only)
T-shirts, apparel, accessories
Home decor (canvas prints, wall art)
Stationery and paper goods
Phone cases and tech accessories
Mugs, pillows, and other merchandise
Publishing:
Book covers and interior illustrations
Magazine and newspaper articles
Blog posts and online publications
eBooks and digital publications
Business Use:
Office decor and signage
Trade show displays
Investor presentations
Client proposals and pitch decks
Restaurant or retail interior design
Digital Products:
(Extended License only)
Website themes and templates
App UI elements
NFTs (with specific terms)
Digital downloads for resale

5. PROHIBITED USES
Even with Commercial License, you may NOT:
5.1 Restricted Uses:
Claim original artistic creation (AI-generated disclosure recommended)
Trademark or copyright the artwork as original
Use in defamatory, illegal, or adult content
Resell or redistribute the raw AI model
Use in training other AI models
Create competing AI art services
5.2 Sensitive Uses:
Political campaigns (requires written approval)
Tobacco, alcohol, or pharmaceutical marketing (may require approval)
Content depicting identifiable individuals without consent
Uses that could harm Fable's reputation
6. LICENSE TRANSFER
6.1 Non-Transferable: Commercial Licenses are generally non-transferable.
6.2 Business Sale: If your business is sold, contact us to transfer the license (may require fee).
6.3 Client Work: You may create artwork for clients, but clients receive usage rights, not the license itself.
7. ATTRIBUTION
7.1 Optional: Attribution is not required but appreciated:
"Artwork created with Fable by Surrealium"
7.2 Portfolio Use: You may show the artwork in your portfolio as work created using Fable.
7.3 Misrepresentation: You must not claim you created the artwork without AI assistance.
8. PURCHASE PROCESS
8.1 How to Purchase:
Generate your artwork with any paid plan
Navigate to "Commercial License" option
Select license type (Standard or Extended)
Complete secure payment
Receive license certificate and high-res file via email
8.2 Proof of License: You will receive a digital certificate with:
License type and scope
Artwork identifier
Purchase date
License terms
8.3 Record Keeping: Keep license certificate for your records and any disputes.
9. VERIFICATION & ENFORCEMENT
9.1 License Verification: Fable may verify commercial usage against purchased licenses.
9.2 Unauthorized Use: Using artwork commercially without proper license may result in:
Cease and desist notice
Invoice for retroactive licensing
Legal action for damages
Account termination
9.3 Good Faith: We prefer resolving issues amicably. Contact us if you need help with licensing.
10. REFUND POLICY FOR COMMERCIAL LICENSES
10.1 Non-Refundable: Commercial licenses are generally non-refundable once granted, as they immediately provide commercial usage rights.
10.2 Technical Issues: Refunds may be provided if technical issues prevent artwork download or use.
10.3 Wrong License: If you purchased the wrong license type, we may exchange within 7 days.
11. MODIFICATIONS & DERIVATIVES
11.1 Editing Allowed: You may modify the artwork for commercial use:
Color adjustments
Cropping and resizing
Adding text or graphics
Combining with other elements
11.2 Derivative Works: Derivatives must still comply with license restrictions.
11.3 AI Re-generation: Using the artwork as input to other AI tools may require additional licensing depending on the tool's terms.
12. MULTIPLE USES
12.1 Single Artwork: Each license covers one specific generated artwork.
12.2 Multiple Products: Extended License allows unlimited products using the same artwork.
12.3 Variations: If you generate multiple variations of similar artwork, each requires its own license for commercial use.
13. NFTs & BLOCKCHAIN
13.1 NFT Sales: Selling artwork as NFTs requires Extended Commercial License.
13.2 Rights Transfer: Specify license terms when selling NFTs (you may transfer usage rights but not regeneration rights).
13.3 Royalties: NFT royalties flow to you as the NFT creator, not to Fable.
14. INTERNATIONAL USE
14.1 Worldwide Rights: Commercial licenses grant worldwide usage rights.
14.2 Local Laws: You are responsible for compliance with local laws regarding commercial use.
14.3 Export Restrictions: No export restrictions apply to digital artwork files.
15. LICENSE DURATION
15.1 Perpetual: Commercial licenses do not expire.
15.2 Termination: License may be terminated if:
You violate license terms
You use artwork in prohibited ways
You fail to pay for license (in case of payment dispute)
15.3 Post-Termination: Upon termination, you must cease commercial use immediately.
16. LIMITATION OF LIABILITY
16.1 Fable is not liable for:
Commercial success or failure of projects using artwork
Third-party claims regarding artwork use
Loss of profits or business opportunities
16.2 Maximum Liability: Our liability is limited to the license fee paid.
16.3 Warranty Disclaimer: Artwork is provided "as is" for commercial use.
17. INDEMNIFICATION
You agree to indemnify Fable from claims arising from:
Your commercial use of artwork
Your violation of license terms
Your misrepresentation of artwork origins
18. DISPUTES
18.1 Informal Resolution: Contact hello@fable.art to resolve licensing questions or disputes.
18.2 Binding Arbitration: See Terms of Service for formal dispute resolution.
18.3 Legal Fees: Prevailing party in disputes may recover legal fees.
19. CHANGES TO LICENSE TERMS
19.1 Future Changes: Changes to this Commercial License Agreement do not affect already-purchased licenses.
19.2 Grandfathered Rights: Your purchased license terms remain in effect as per purchase date.
19.3 New Purchases: New license purchases are subject to current terms.

21. EDUCATIONAL & NON-PROFIT USE
21.1 Educational: Educational institutions may qualify for discounted commercial licensing.
21.2 Non-Profit: 501(c)(3) organizations may receive reduced-rate licensing (contact us).
21.3 Religious Organizations: Special terms available upon request.

23. LICENSE CERTIFICATE
Upon purchase, you receive a certificate including:
Unique License ID
Artwork thumbnail and ID
License type and scope
Purchase date and price
Licensee name and email
Terms summary
Keep this certificate with your business records.
24. COMPLIANCE & BEST PRACTICES
24.1 Document Usage: Keep records of how and where artwork is used commercially.
24.2 Internal Sharing: Educate team members about license restrictions.
24.3 Contractor Use: Contractors working on your projects may use artwork under your license.
24.4 Regular Review: Review license terms periodically to ensure compliance.
